Instance where Char.ini files are not writing to \appdata\...\phoenix

Trying to help a friend load the game. Has LIVE DAoC on one drive and PHX DAoC folder on another drive.
Patched, downgraded, and runs PHOENIX.EXE and creates a new character. The Character ini files are being written to his LIVE (\appdata...\LOTM) directory and not .\phoenix.

I had him delete the user.dat and char.bin from live folder (renamed them) and rerun the phoenix.exe - from the options at char creation had him choose ATLANTIS (no custom UI) and create a char. The character INI files are STILL being written to the LIVE \LOTM directory.

What am I missing? thanks for the help in advance

For my computer I have the following directories in \appdata....
LotM for LIVE
Phoenix for Here
Test for Pendragon (live test)

and recently BOTS directory. I think live has instituted some changes where it creates virtual directories now and they are trying to mess with the default.ini versions of char files in an attempt to support higher resolutions. This is something I have noticed recently just in the past several months.

So he renamed LOTM to LOTM.OLD and Phoenix Launcher recreated LOTM directory.

Current workaround is DONT create a toon you have on live that you care about the .ini file being overwritten

In my PHOENIX directory, I notice a file called PATHS.DAT with the following in it:

[paths]
settings=phoenix_

which leads me to believe that file might fix his problem...
