In what world do people live in that a 62/38 split isn't a large enough consensus?
In germany we have something called "Zweidrittel Mehrheit" (translates to two-third-majority) for important decisions like changing the constitution. There is the simple two-third-majority which requires at least two-thirds of the voting persons to vote for something. And there is even a stricter version, the absolute two-third-majority where two third of all available voters (not only participating voters) have to vote for one option.
Afaik this system is used in many democracies around the world for specific decisions.
I don't think this would make sense for the OF/NF-decision on phoenix, just saying that 62/38 split isn't a large enough consensus for all decision in many civilized countries of the world we all live in.
There is still no indication that the vote was the lone decider on OF or NF though, quite the contrary. From the announcement wording I personally take that it was just one of many factors that they considers and the sum of all factors made them decide that NF is the way to go
